What must a transfer agreement contain?

Takeover/transfer agreements can be concluded in case of donation of an animal or purchase of an animal.
In the absence of special regulations, the usual provisions of the gift and thus the Art. 239ff. of the Code of Obligations (OR) apply in the case of a gift.
If someone wants to take an animal from a home, usually a contract of sale or so-called takeover or animal placement contract is concluded.
Either the purchase price is agreed upon or it is stated that the amount of money paid represents a takeover fee in the sense of a contribution to expenses.
The takeover contract is usually a normal purchase contract, which transfers ownership of the animal to the buyer.
However, a trial period can be imposed on the new owner (e.g. a few weeks), during which he has the possibility to withdraw from the contract. In this way it can be prevented that an animal has to stay with a new owner, which does not want it after all. In many cases, unfortunately, animals from shelters have a history, so the buyer of an animal from the shelter cannot make the same demands on the health and character traits of an animal, as, for example, when buying an animal from a recognized breeding. Animal shelters have often excluded their warranty in their contracts. Therefore, better to study the content of the contract more carefully.
